Senior Magistrate Dies in Nairobi

Mombasa Senior Principal Magistrate Elvis Michieka died on Wednesday, December 2.

He passed away at a Nairobi hospital while he was receiving treatment for the past two weeks. The body has been transferred to Montezuma Funeral Home.

The news was confirmed by Kenya Magistrate and Judges Association Secretary-General, Derrick Kuto.

"We have lost a brother, a friend and a diligent colleague. He is an irreplaceable pillar.  I wish to convey our condolences to the family and friends," Kuto's statement read.

Michieka served as a principal magistrate at the Mombasa Law Courts. Chief Justice David Maraga, in a statement, termed him as a dedicated judge who served the country well.

"Hon. Michieka was a devoted judicial officer who rendered his services to the people of Kenya with exceptional diligence and dedication. 

The CJ noted that the deceased had recently been interviewed for promotion and was awaiting the results of the exercise. 

On behalf of the Judiciary, the Judicial Service Commission (JSC) and on my own behalf, I wish to express our heartfelt condolences to the family, friends and entire legal fraternity for this shocking loss," read part of the statement by David Maraga.

The judge presided over multiple cases in his illustrious career with a recent case being one involving Kilifi Deputy Governor Gideon Saburi.

The Deputy Governor had been charged for willfully exposing himself to members of the public after getting back to the country from Germany. 

The DG defied the Covid-19 protocols where all Kenyans from outside the country were mandated to self-quarantine upon arrival.

The judge ruled that Saburi had to self-quarantine for an extra 14 days after already spending 27 days of confinement and released him on a Ksh200,000 cash bail.
