New President of the Court of Appeal Announced

Justice Daniel Musinga has been elected President of the Court of Appeal on Monday, May 24. 

The Independent Electoral and Boundaries Commission (IEBC) certified his election - clearing the way for him to assume office immediately.

Musinga replaces Justice William Ouko who was appointed as a judge of the Supreme Court on May 13.

Justice Ouko had earlier eyed the top job as the Chief Justice. 

The Court of Appeal President is elected by the judges of the court of appeal to serve for a five-year term. The court currently comprises of 30 judges.

In January, Justice Daniel Musinga was elected as the chairman of the Judicial Committee on Elections(JCE) by retired Chief Justice David Maraga.

The judge has experience of 33 years as a jurist - having started his career in 1988 as an advocate of the High Court of Kenya.

Between 1991 and 2003, he run his own law firm. In 2003, he rejoined the judiciary, where he has been working till date.

During Mwai Kibaki's reign, Justice Musinga challenged the former presidents' order. He had appointed Judge Alashir Vishram and lawyer Githu Muigai as Chief Justice and Attorney General. 

Musinga termed the appointments as unconstitutional, citing failure to consider women for the position and not adhering to set standards for such appointments.

His appointment has been met with congratulatory messages from the legal fraternity.

"Justice Daniel Musinga's timely election as President of the Court of Appeal is great news. He will take the Court to greater heights," Senior Counsel Ahmednasir Abdullahi stated. 

Speaking in an interview seven years ago, he mentioned that being a judge is a calling to him.

"As a judge, one is guided by the law only. The facts of the law, being courageous and a person of integrity. Only then will you arrive at the right decision," he stated.
