A security guard has won a Ksh 171,000 suit after his work contract was unfairly terminated for inquiring about the lavatories at his new work station.
A report by K24 TV on Tuesday, September 14, indicated that the guard identified as Johnson Otsieno Ogola was contracted by a local security firm and assigned to a homestead.
He was hired to cover the night duty but his employer never showed him the washrooms he would use while at work.
Days after he began his new job, Ogola is said to have enquired about the toilets when he alleged that his employer reported him to the management of his agency as being rude.
The security guard was also accused of showing up to work intoxicated.
According to court documents, the management of his agency summoned him before later terminating his contract, in a move the guard termed as unfair.
“He was summoned by his managers in the main office where he was told that he was rude to the client and he been reporting to work while intoxicated. Consequently, he was terminated.
"It is his contention that no notice to terminate was issued to him prior to his termination and neither was a disciplinary hearing conducted,” argued Ogola's team.
At the time, Ogola was earning Ksh9,000 salary per month. The incident occurred in September 2016.
Ogola's lawyers further claimed that while under his contract, Ogola often worked overtime but his agency was yet to offer him a house allowance.
In his ruling, Judge B Manani directed that Ogola be awarded the money for wrongful dismissal. Part of the money was channelled to his house allowance.
Ogola noted that he sought the services of a lawyer after his agency refuted his claims.
