A Kenyan-American businessman wanted by the Rwandan Government to serve a court sentence has wedged a fresh battle against his extradition. 

The tycoon, Nathan Loyd Ndung’u, filed a suit at the High Court, seeking intervention against his deportation to the East African nation.

Ndung'u was reportedly placed under Interpol's red alert after he was accused of defrauding property buyers in Rwanda before his company went bankrupt.

It was alleged that he promised to construct houses for the Rwandan citizens through his company. 

Reports indicated that he was sentenced to a five-year jail term in Rwanda while in absentia. He allegedly fled Rwanda in 2011 at the height of investigations against his company.

The accused, however, argued that the criminal charges levelled against him were erroneous, claiming that he settled the matter with the Government of Rwanda.

“There is no basis for the applicant to be unreasonable and maliciously harassed by the Government of Rwanda and he urges this honourable court to urgently intervene because his life is under threat from the said government.

"The issues relating to the said housing development project were successfully negotiated and settled by the company, the developer, and Government of Rwanda which was represented by the Minister of Justice and Rwanda Development Board in the year 2012. A settlement agreement was entered into all government relevant agencies and the company on August 22, 2012," read the court documents according to Business Daily.

Ndung'u argued that the Government of Rwanda was using Interpol to harass him and claimed that his life was in danger.

The tycoon was arrested at Jomo Kenyatta International Airport (JKIA) shortly after touching down on January 31 from the US. 

He was, later on, released on a Ksh1 million bail, on Monday, February 7.
