EACC Recovers Ksh74 Million From Ex-KPA Boss

The Ethics Anti-Corruption Commission (EACC) has been allowed to recover over Ksh74 million from former Kenya Ports Authority (KPA) Managing Director, James Mulewa Mwathethe.

In a court ruling delivered Thursday, July 14, the High Court directed EACC to collect Ksh63,683,794, a total sum that was wired to Mulewa's account and which he could not explain the source.

Another Ksh11 million is the value of immovable property belonging to him that will now be confiscated by the anti-graft Commission.

According to court documents, the former KPA boss received the millions between May 20 and August 3, 2010.

So far, EACC has already recovered Ksh22 million from him.

The case has been before court since 2017 when the anti-corruption agency first sort to recover proceeds of corruption from the ex-KPA boss.

During that time, EACC sort to have Mulewa forfeit Ksh17 million in form of "land properties" which the agency stated constituted unexplained assets.

The lands were registered as parcel No. MN/1/13483 and No. MN/1/15351, both located in Mombasa.

"The defendant to also pay Ksh683,861 being cumulative interest of bank deposits, costs of the suit to the plaintiff," the court ruled.

The former KPA boss was removed from office in 2010 after serving as the MD for two years. He was sent home after allegations of impropriety were levelled against him.

In a letter, former Transport Minister, Chirau Ali Mwakwere, asked then Permanent Secretary, Cyrus Njiru, to either suspend or sack Mulewa for alleged corruption.

The letter stated that Mulewa had allegedly "presented false information on KPA's financial position and placing huge orders for the supply of equipment without the prior availability of funds".
