Uganda's military general, Muhoozi Kainerugaba, risks being charged with treason after an advocate filed a case at the Milimani Law Courts in Nairobi on Friday, October 21.

Advocate Apollo Mboya in his suit, challenged the Director of Criminal Investigations (DCI) Amin Mohamed to furnish the court with an investigation report against President Yoweri Kaguta Museveni's son.

Mboya accused the Acting Inspector General of Police, Noor Gabow, DCI Amin and Director of Public Prosecution, Noordin Haji, of overlooking the impacts of Muhoozi's statements, especially his threat to capture Nairobi.

"That Muhoozi Kainerugaba, the 3rd Respondent who is a Senior Military Officer in the neighbouring country of Uganda, has committed treasonable offences of threatening national security, territorial integrity and sovereignty of Kenya after expressing his intention to launch a military invasion to capture Nairobi, the capital city of the Republic of Kenya within two (2) weeks," the petition read in part.

Further defending his suit, Mboya maintained that Muhoozi's sentiments could not be assumed since he yields more power following his promotions in Uganda's Army ranks.

"The Head of State of the Republic of Uganda who is also the Commander of the Uganda Peoples' Defence Forces (UPDF), has rewarded Lt. General Muhoozi Kainerugaba by promoting him to a full General of the Uganda Peoples' Defense Force (UPDF) following his threats to invade Kenya thereby conferring additional capabilities to General Muhoozi Kainerugaba," he argued.

He referenced his arguments to Section 43 of the Penal Code, maintaining that Muhoozi threatened Nairobi's territorial integrity.

Mboya thus asked the Milimani Law Court court to certify his application as urgent to allow Muhoozi to be charged.

However, Muhoozi, in his response to Mboya, opined that those who have filed the suit should be apprehended instead.

"Haha! Maybe I should arrest the ones who are charging me with treason?" He posed on Friday, October 21.

His Controversial Nairobi Tweet

Muhoozi claimed that it would have taken his army just two weeks to capture Nairobi. The tweet attracted uproar forcing President Museveni to formally apologise to President William Ruto

"Dear Ugandans, the brotherly people of Kenya, and all East Africans.  I greet all of you. I ask our Kenyan brothers and sisters to forgive us for the tweets sent by General Muhoozi," Museveni stated.

"It is not correct for Public officers, be they civilian or military, to comment or interfere in any way, in the internal affairs of brother countries," Uganda's President added.
