CS Mithika Linturi Allowed to Kick Mary Kitany Out of Runda Mansion

The High Court on Friday, January 20, rejected a request by Aldai Member of Parliament Marianne Kitany seeking to bar Agriculture Cabinet Secretary Mithika Linturi from kicking her out of a Runda residence.

Kitany had moved to the High Court seeking to invalidate a ruling by a magistrate court that established that there was no marriage between the two leaders. 

On his part, Linturi - through his lawyer - argued that the MP wanted to hold on to the property despite a ruling affirming that she had no right to lay claim.

"Marianne wants to continue living in the palatial home for the sixth year running yet the court had established that there was no marriage between me and the appellant," Linturi's lawyer told the court. 

However, Justice Maureen Odero ruled that the court had no jurisdiction over the matter citing a previous ruling by the Court of Appeal that declined a similar request by Kitany. 

Consequently, the judge declined the request to prevent Linturi from repossessing the residence. 

The two had been embroiled in a divorce case alongside other disputes regarding ownership of properties between the duo.

In what turned out to be a series of controversies, Linturi was left shifting from one case to another as the tussle continued.

During his vetting for the CS position, Linturi claimed a court injunction and restraining orders barring him from accessing the properties had been introduced.

In September 2022, Magistrate Heston Nyagah ruled that the Aldai lawmaker failed to adduce enough evidence proving that she was lawfully married to Linturi - a few weeks after his appointment. 

This complicated her pursuit of the possession as she could no longer lay claim to the property hence taking the dispute to the High Court.
