The University of Nairobi Lecturer Dr Zakayo Limiri Thaimuta addressed the court over an ongoing case pitting Jacob Ocholla and former President, the late Mwai Kibaki's children.
In his affidavit, Dr Thaimuta who spoke to Kenyans.co.ke, explained that he conducted human pathology examination on both Ocholla and the former President's photographic evidence and concluded that the two truly resembled each other.
Ocholla who claims to be Kibaki's son is now relying on the medical report to prove to the court that he was sired by the former Head of State.
“Upon analysis of photos, I form an opinion that there is a significant similarity between the two individuals: Jacob Ocholla Mwai and Mwai Kibaki,” Thaimuta wrote in his medical report.
According to human pathology by Dr Thaimuta, Ocholla's resemblance to Kenya’s third President is not an ordinary coincidence.
On January 19, 2023, Dr Thaimuta filed an affidavit before the High Court stating that he received a request from Ocholla asking him to provide a medical report on his similarity with Kibaki.
"I proceeded and examined the evidence availed before me and made the logical conclusions about the case," Ocholla explained.
After analysis of the anatomical features of both Kibaki and Ocholla, Thaimuta made observations which he placed before the Judge.
“The following items are distinctly identifiable: The craniofacial features and morphology of nose, forehead, eyelids and lips resemble.
"The cheeks and cheekbone are similar. Sustained eye contact and eye blinking are similar. The baldness between the compared photos is similar. Speech and lips movement (also show) similarity,” Thaimuta added.
Kibaki's children, however, refused to allow a DNA test which Ocholla's Lawyer Morara Omoke was pushing for in an attempt to confirm the identity of his client.
While urging the court to dismiss the request for orders of siblings to undergo a DNA test, former President Kibaki's children claimed that DNA would violate their privacy.
In his affidavit, Thaimuta stated that the 62-year-old Ocholla's physical features suggest that Ocholla and Kibaki were related.
“Phenotypic assessment outcome be validated with either siblingship test or paternity test. Siblingship test be applied if there are known relatives of the deceased. In this case, Y chromosome analysis will be dependable,” Thaimuta explained.
Ocholla filed a case in April 2022 seeking to be recognised as a son of the former Head of State and a beneficiary of his vast estate.
A High Court sitting in Nairobi will on July 28, 2023, hear and give further directions on the matter that stopped Kibaki's children from diving their father's estates.
