Matiang'i Will Show Up - Lawyer Danstan Omari Confirms After Official Summon

Former Interior Cabinet Secretary Fred Matiang'i's lawyer Danstan Omari has confirmed that his client will appear at the Directorate of Criminal Investigation (DCI) headquarters along Kiambu Road on Tuesday, March 7. 

Speaking to Kenyans.co.ke on Monday, March 6, Omari confirmed that he had received the official summon requiring his client to appear at 9:30 am.

A statement issued by Michael Sang, a senior Superintendent of police attached to the DCI Headquarters' Serious Crimes Unit, had earlier noted that the DCI was investigating allegations of publication of false information regarding the alleged invasion and raid of the former CS's home based in Karen on February 8, 2023. 

The DCI officer pointed out that should the allegations be deemed true, it would contravene section 23 of the Computer Misuse and Cyber Crimes Act 2018 amongst other offences.

According to the Act, a person who knowingly publishes information that is false in print, broadcast, data or over a computer system that results in panic or chaos among citizens or which is likely to discredit the reputation of a person, commits an offence. 

Hence, the person is liable upon conviction to a fine not exceeding Ksh5 million or to imprisonment for a term not exceeding ten years, or both. 

"I have reasons to believe that you, Dr. Fred Matiangi, the former Cabinet Secretary, Ministry of Interior and National Co-ordination, is connected to the offence or has information which can assist me in my investigations," the statement read in part. 

The DCI officer warned Matiang'i that failure to comply with the summons would constitute an offence liable to prosecution. 

The news comes after the former CS failed to appear at the DCI headquarters on Monday, March 6.

His lawyer, Danstan Omari, revealed that his client was not aware of the summons as the DCI did not follow the proper channel. 

"He is not aware of any investigations on him but reckons those constitutional offices are at liberty to discharge their mandate; and that he, too has the right to follow due process as a citizen of this country," Omari noted. 

The former CS flew back to the country on Saturday night, March 4, following a two-week trip to the United Kingdom to attend to family matters. 

This was met with heavy criticism from Kenya Kwanza politicians who claimed that Matiang'i sought refuge outside the country. 

"He was called to record a simple statement but he decided to flee. Didn't I tell you that these people were cowards?

"They came after us before the elections, but did we run? They arrested me and took away our property and we stayed put," Deputy President Rigathi Gachagua stated during a recent rally.
