Orange Democratic Movement (ODM) Members of Parliament have set in motion a plan to impeach Treasury Cabinet Secretary Njunguna Ndungu over the delay of the disbursement of National Government Constituencies Development Funds (NG-CDF).
The MPs warned that they had collected signatures to petition the National Assembly Speaker Moses Wetangula to recall Parliament for a special seating where the impeachment motion will be discussed.
"We have already appended our signatures to the petition fronted by our whip Mark Mwenje, and through the coordination of MP Otiende Amollo (Rarieda) and the leadership of the house," Matungulu MP Steven Mule stated on Wednesday, January 17.
According to Mule, the funds that were to be disbursed by December 20, 2023, had not reached constituency accounts as promised by CS Ndungu.
The MPs further gave the CS two conditions to either release the money or face impeachment.
Mule remarked that the delay of funds has constrained the operations of the constituencies especially schools that were reopened.
“We need to be able to get back to the constituency and assist parents and students who are getting back to school. We are not going to delay in this war,” Mbule stated.
Kathiani MP, Robert Mbui on January 16, declared that he was ready to sponsor a petition to impeach the CS if the funds were not released in due course.
However, the government on its side maintained that the money was disbursed into the constituency's accounts.
The chairperson of the Budget and Appropriations Committee in Parliament, Ndindi Nyoro had also affirmed that the money meant for bursaries under the NG-CDF kitty would be released before students report for their first term.
CS Ndungu further watered down the impeachment plans, adding that the reasons cited for his ouster were not enshrined in the Constitution.
“You cannot be removed from office unless one has violated the constitution. Lack of money is not a constitutional violation," the CS stated in an interview with the media.
"Indeed, you should be asking the MPs that since they are the lawmakers, what violation of the law or constitution is evident,” he added.
