Kenya Kwanza MP Warns Contractors Firing Workers After Housing Levy Ruling

Mbeere North MP Geoffrey Ruku, who is allied to the ruling Kenya Kwanza Coalition, has warned contractors against firing workers from Affordable Housing construction sites.

Speaking to the press on Wednesday, the lawmaker directed that all contractors should let their employees continue to work as the government figures out the way forward.

Ruku further cautioned that contractors who defy the directive will risk losing their jobs.

"It is important for all contractors who have been on sight to know that in case you send away the artisans and fundis working on your project because of the ruling of the court, it will be deemed that you are working with Azimio and you will be treated as so," he remarked.

"We can institute the process of terminating your contract to have other contractors get that work ongoing."

Reports had earlier emerged that the Ministry of Lands was alerted over contractor concerns on the future of the project after the ruling.

"The Ministry urges for calmness in the sector and encourages the developers, contractors, suppliers and workers to carry on with their activities," the Ministry's statement to outlets stated.

On Friday last week, the Court of Appeal termed the Housing Levy deductions unconstitutional and ordered the State to halt them.

The government had asked the three-judge bench comprising Justices Lydia Achode, John Mativo and Mwaniki Gachoka to allow the taxman to continue collecting the levy before the case is determined.

"The trial court held that the Housing Levy was introduced without a legal framework. It also held that the levy was targeting a section of Kenyans. In our view, the public interest lies in awaiting the determination of the appeal,” the three-judge bench ruled.

Minutes after the ruling, the Head of State affirmed that his administration would push on with the housing agenda despite the many obstacles he was facing.

In an earlier address, the Head of State indicated that since launching the project, more than 120,000 jobs have been created.

Some of the construction workers, on Tuesday, held demonstrations outside Milimani Law Courts in support of the rollout by the Head of State. A Housing Levy Bill is currently undergoing public participation.
