Nonini Issues Demand Letter to Ezekiel Mutua in Row Over Artists' Revenue

Popular musician, Hubert Mbuku Nakitare (Nonini) has issued a demand letter to the Chief Executive Officer (C.E.O) Ezekiel Mutua, of the Music Copyright Society of Kenya (MCSK) over defamatory remarks.

According to the demand letter, Nonini has noted that Ezekiel Mutua, made defamatory remarks on his personal X (Formerly Twitter) platform, accusing him of fraud.

Further, the demand letter states that Ezekiel Mutua termed the musician as a fugitive a label which is contrary to his status as he currently resides in the United States of America.

“There's this fugitive Nonini who embezzled musicians (sic) money when he was a director of MUPAKE (sic) and PRISK. We reported him and his gang to the police last week and we are pursuing their prosecution,” read the post in part.

The Musician through his lawyer has made three demands to the MCSK chair, in which failure to adhere to each would lead to a lawsuit.

In the letter, the first demand is that Ezekiel Mutua pulls down the post regarding Nonini on X and any other platform.

Further demands also require that the MCSK C.E.O. issue an unconditional apology to the artist within the next 24 hours.

Additionally, according to the letter, the artist would engage Ezekiel after the earlier two demands were met.

Further in, Nonini has clarified that the documents that Mutua had claimed were forged are legitimate with him providing copies to his attorneys.

“To sum it up, our client has instructed us and furnished us with a copy of the letter written by yourself to Kenya Copyrights Board (KECOBO) dated 24 January 2024," stated the letter.

He has further claimed that the letter he posted on social media, was written by Ezekiel Mutua where he had referenced the MCSK statement of Accounts and revenue distribution list from January to December 2023 which appeared on page 5 of 5 of the letter.

The artist also noted that Ezekiel Mutua needed to dispense his mandate in full without discrimination of any kind.

“As a government official, your role remains to serve the people of Kenya regardless of their colour, creed, race, sexual orientation or religious beliefs. That way you won't have time to be overzealous and annoying whenever you speak up,” read part of the letter.

However, at the time of this publication, Ezekiel Mutua has yet to pull down the post in contention from his social media platform.
