The former president of the Law Society of Kenya (LSK) Nelson Havi on Friday, March 8, issued a seven-day ultimatum to Chief Justice Martha Koome.
Havi demanded the cancellation of the judges' interviews scheduled for April, 2024, until Samson Omwanza Ombati, the LSK male representative to the JSC assumes office.
The chairperson of the Retirement Benefits Authority (RBA) also called for the immediate revocation of the appointment of Alexander Muteti and James Warui as Judges of the High Court of Kenya.
“Confirm in writing within 7 days from the date of this letter that the interviews scheduled for April 2024 are cancelled," Havi stated.
"Legal action will be commenced in the event of failure by the JSC to act as requested."
According to Havi, Muteti's record during his tenure at the helm of the Office of the Director of Public Prosecutions (ODPP) was marred by gross violations of the Bill of Rights.
Havi went ahead to reveal incidents where Muteti compromised the law. One such incident, according to Havi, was the prosecution of Kisumu senator Tom Ojienda.
In his claims, Havi noted that Muteti went after Ojienda to frustrate his candidature for re-election as the LSK male representative to the JSC.
Meanwhile, Havi claimed that Warui did not deserve the role of the high court judge since he was once implicated in a nefarious scheme contrived by several advocates and judges to thwart the prosecution of Kamlesh Mansuklal Dhanji Pattn.
According to Havi, Pattn's case on the Goldenberg scandal which was at the Nairobi High Court Miscellaneous (Judicial Review) Application No 305 of 2012 wasn't concluded.
"This case was compromised by the Chief Magistrates Court, the High Court, the Court of Appeal and the Supreme Court with the active participation of Warui. The matter remains unresolved to date," Havi claimed.
Nelson Havi called on the Chief Justice, Martha Koome, to respond to his demands, threatening to file a petition against the judiciary in case his above demands are not met by March 16.
