CS Faces Probe Over Election Offence

Energy Cabinet Secretary Charles Keter is now being investigated over his involvement in the Kericho by-election, the Independent Electoral and Boundaries Commission (IEBC) has confirmed.

The probe follows concerns raised by the Opposition and KANU party which both suggested that public resources were used in the Kericho and Malindi campaigns during the by-elections.

Keter was seen actively campaigning in Kericho for the then Jubilee Senatorial Candidate Aaron Cheruiyot, despite being restricted by the Election Act in the constitution.

Section 43 of the Election Act states: "A public officer shall not publicly indicate support for or opposition against any party, side or candidate participating in an election; engage in political campaigns of other political activities."

"A public officer who contravenes subsection (1) commits an offence and is liable on conviction, to a fine not exceeding one million shillings or to imprisonment for a term not exceeding three years, or to both," states the Act.

KANU's Paul Sang accused the ruling coalition of using government resources and state officers in his rival's campaigns hence demanded for probe against Keter.

IEBC on Wednesday told the Standard that it had received the complaints and was not only investigating Keter but also other state officers.

In the Kericho by-election, Mr Cheruiyot emerged the winner with 109,358 votes, trouncing his closest competitor Paul Sang who garnered a total of 56,307 votes.

The Senatorial seat fell vacant after CS Keter's appointment to cabinet.
