The Late Nyeri Governor Nderitu Gachagua's Family To Receive Land Compensation From The National Land Commission

The family of the late Nyeri Governor Nderitu Gachagua is set to receive hundreds of millions of shillings as compensation for their land which was acquired by the Government.

The family will receive the hefty amount from the National Land Commission (NLC) after their land was obtained by the Government to facilitate expansion of the Southern Bypass.

The 1.2-acre piece of land located in Nairobi’s South C estate has 80 apartments built on it and is registered under Gachagua family’s company, Vipingo Beach Resort Limited

The late Gachagua owned an 89.94% stake in the company, a Susan Nderitu owns 10%, Gachagua’s brother Rigathi Gachagua owns 0.01% while a Mr Kenneth Gachagua owns 0.05%.

The NLC issued a notice through the Kenya Gazette inviting parties interested in the investment to file claims for compensation by 3rd April.

The notice states in part, “Every person interested in the affected land is required to deliver to the National Land Commission on or before the day of inquiry a written claim to compensation, copy of National Identity Card (ID), Personal Identification NO. (PIN), land ownership documents and bank account details.”

In 2012, Vipingo Beach Resort filed a suit in court claiming that the property’s value amounted to Sh800 Million.

The NLC requested time to evaluate and determine how much the government was required to pay in compensation.

In February 2016, the High Court Ruled that Gachagua be compensated at a rate determined by the NLC.
