Muturi: I Will Not Stop Waiguru Impeachment Motion

National Assembly Speaker Justin Muturi has snubbed court orders to stop the motion to impeach Devolution and Planning Cabinet Secretary Anne Waiguru.

Muturi said that he would approve the motion once it reached him as Parliament was guided by Standing Orders in matters of tabling motions.

The Speaker added that the issue was a legislative one and the court had no power to bar the impeachment motion.

"These are matters left to the Legislature. No one can tell Parliament what to do. Nobody can dictate to the House. We are not children, we are not toddlers. If the motion comes before me, I will approve it using the normal procedures," Muturi stated.

Muturi further mentioned that no court order had reached his office to deter the impeachment motion against CS Waiguru and emphasised that even if it did, he would not stop the motion.

Majority Leader Aden Duale had also earlier pointed out that the court had no jurisdiction to deny the National Assembly exercise of its constitutional function.

The High Court on Monday blocked the debate on a motion seeking to impeach the Devolution Cabinet Secretary.

Justice Joseph Onguto granted CS Waiguru a temporary reprieve after the Commission on the Implementation of the Constitution moved to court to challenge the impeachment of Cabinet Secretaries by the National Assembly, arguing that Section 66 of the Standing Orders was unconstitutional and should be declared null and void.

According to CIC Chairman Charles Nyachae, the Standing Orders would not accord any CS a fair hearing before the National Assembly. He further argued that the Standing Orders were inconsistent with Article 50 of the Constitution which gave every accused person the right to fair trial.
