Renewed Court Battle Over Ownership Of Mama Lucy Kibaki Hospital Grounds

The land on which Mama Lucy Kibaki Hospital as well as Nairobi's Umoja II estate are built, is at the centre of a 43-year old legal dispute.

The hospital together with Umoja II Estate, Kenya Cooperative Creameries (KCC), Steel Structures, administration offices, schools and other social amenities are lying on an 818 acre parcel of land being contested for by Dandora Housing Schemes Limited (DHS) and Kiambu Dandora Farmers Company Limited (KDFC), the Nation reports.

In a renewed court battle DHS is asking the court to compel the chief registrar of lands to issue it with a provisional title deed saying the original one got lost but lawyer Boniface Njiru representing KDFC told Justice John Mutungi that he has the original title to the land in dispute and that he is willing to produce it before court for perusal.

It is alleged that in 1985 the High Court quashed the government’s decision to acquire the parcel of land for public utility and reverted it to DHS but KDFC is also claiming ownership of the land.

KDFC is said to have earlier last week advertised for the sale of some plots on the disputed land.

State counsel Thande Kuria has asked the judge to enjoin the National Land Commission (NLC) into the case since the case is of public interest due to the situation of Umoja II estate on the contested land.

Judge Mutungi has ordered NLC and KDFC to appear in court on July 1, 2015 for the hearing of their pleas.
