Why ICC Rejected Ruto's Request to Probe Bensouda

Deputy President William Ruto on Thursday suffered a blow after his request to have the International Criminal Court Investigate Chief Prosecutor Fatou Bensouda's staff was rejected.

Following the termination of his case on crimes against humanity in April, Ruto through his lawyer Karim Khan filed a suit against Bensouda's staff accusing them of procuring witnesses.

In their decision, judges Chile Eboe-Osuji, Olga Herrera Carbucchia and Robert Fremr declared Ruto's application personal and was meant to go after certain individuals at the investigator's office.

"The Chamber notes the evident acrimony that permeated the parties' submissions. As the record of the trial proceedings in the Prosecutor v Ruto and Sang case shows, this Chamber has consistently discouraged such attitude on the part of counsel appearing before it,” read part of the statement from the judges.

The judges accused Khan of being unprofessional in the quest.

Additionally, Ruto was accused of making the application too late, because when his case was closed, everything related to it also closed.

"The decision of 5 April 2016 was made final, as it was not appealed by any of the parties,” the judges said.

Ruto's lawyer had asked the ICC judges to push Bensouda to order an independent investigation into the alleged misconduct by her staff.

The ICC prosecution staffers were accused of having sex with some witnesses, bribing them and even filing fraudulent claims besides coaching them.
