Moses Kuria Acquitted of Hate Speech Charges

Gatundu South Member of Parliament (MP) Moses Kuria has been acquitted of incitement charges over remarks he had made on his Facebook page.

The court on Thursday dismissed the case stating that the prosecution did not provide enough evidence.

The MP was accused of making inflammatory statements seemingly accusing members of one community of being behind a 2014 terror attack in Nairobi's Gikomba market where several people lost their lives.

Though the message was pulled down, he was charged with hate speech, incitement to violence and propagating ethnic hatred.

Kuria has been battling several cases of fanning ethnic violence especially since he became the Gatundu MP.

In February, Kuria was similarly acquitted of accusations of allegedly calling for the assassination of ODM leader Raila Odinga.

Presiding over the case, Nairobi Magistrate Charity Oluoch, ruled that the English and Kiswahili translations provided as part of the evidence in the case were incorrect.

Ms Oluoch further cast doubt on the video presented as evidence highlighting that it could have been altered.
