3 IEBC Officials Charged in Kangundo Court

Three IEBC officials have been arraigned in a Kangundo court and charged with breach of election law.

Cecilia Mbula, Boniface Mutungi and Stephen Okoth were accused of presenting unsecured used and unused ballot papers to a constituency Returning Officer in Machakos county.

Kangundo senior principal magistrate Desdarius Orimba heard that the three, in violation of their official duty, presented the materials to the RO at the National Industrial Training Institute on August 9, 2017.

The Magistrate charged the suspects in accordance with Section 6 (J) of the Election Offences Act, 2016 which states that a member of the Commission, staff or another person who without reasonable cause does or omits to do anything in breach of his official duty, is guilty of an offence.

The charge sheet did not specify which seat among the six contested in the poll was affected.

The defence lawyers led by Daniel Mwamba and Otieno Javana asked to be supplied with the charge sheet and the witness statements.

Magistrate Orimba released the suspects on a Sh300,000 bond or Sh100,000 cash bail each.

He stated that the case would be mentioned on October 19, 2017.

In August, three IEBC polling clerks were arraigned in a Malindi court and charged with election-related offences.

The clerks were accused of failing to validate registered voters details during the electoral process in various polling stations in Malindi. They were released on a bond of Sh100,000 each.
