High Court Judge John Mativo Dismisses Case by Kilimani Mums

High Court Judge John Mativo was left confused after two women who are members of the famed Kilimani Mums Udaku Zone Facebook group presented a case involving a husband to one of them.

The three involved parties were entangled in a love web where one of the women identified with initials as WMG accused CMN of drugging her husband and having an affair with him.

CMN took WMG to court claiming that the woman had infringed on her privacy and injured her reputation on social media when she publicised details of the affair she had with the husband.

Justice Mativo had a difficult time understanding what exactly had brought the women to court as neither of them demonstrated that their constitutional rights were violated.

The Judge was further confounded that neither of the parties had questioned the authenticity of the posts on Facebook, rather, all parties agreed that the accusations were a true representation of the facts.

"I am not persuaded that the petition discloses any violation of constitutional rights as alleged.

"It is my finding that the truth of the postings complained is not in dispute. It has not been shown that the postings are factually wrong. Further, no malice has been proved," the Judge ruled as he dismissed the confusing case.

CMN further blamed WMG for numerous inquiries that she received from strangers seeking to find out more information on the affair.

In the Facebook post, the aggrieved wife had cautioned the members of the group against CMN, an action that led to the court case.

"… It’s a lot of pain the fact she drugged my husband in her house and had an affair with him. She is now pregnant. My husband says he has no feelings for her. Please, everyone, be warned, she will get your men," the had posted.

Defending herself, WMG claimed the affair that had resulted in a pregnancy had caused her psychological pain.

The two women are said to have been great friends before the affair was uncovered.
