DCI Pursues Lawyer Tom Ojienda Over Mumias Sugar Graft

The Directorate of Criminal Investigations (DCI) is after city lawyer Tom Ojienda accusing him of graft at Mumias Sugar Company.

The lawyer, who is representing Governor Evans Kidero, had, two weeks ago, filed a suit in the court of law barring the DCI from investigating him.

Ojienda argued that DCI was only after him because of forged entries in tax register and payments in legal fees.

In response, DCI, however, affirmed that they were investigating him over the loss of money at the struggling sugar miller located in Western Kenya.

DCI further explained that the state has a stake in the Nairobi Stock Exchange-listed miller and has even pumped billions of shillings in an attempt to revive it.

These investigations by the DCI are purely aimed at discovering whether Mumias Sugar Company or any other person was involved, aided, connived, and or facilitated in the commission of the crime under investigations,” read the affidavits by the DCI.

The investigations seek to unearth details on whether the lost state funds were fraudulently siphoned out.

Previously, Ojienda had represented Mumias Sugar Company in one of its court battles.

He is now representing former Nairobi Governor, Kidero, who is being investigated by the Ethics and Anti-Corruption Commission (EACC) for allegedly embezzling funds during his tenure at the miller and the County Government.

High Court Judge Chacha Mwita, on November 2, forbade the DCI and Kenya Revenue Authority from opening civil and criminal proceedings against the lawyer in relation to tax.
