UPDATE: Kenya Institute of Management student, Billy Graham, who shouted in Court during Embakasi East MP Babu Owino's bail hearing has been set free after admitting it was a mistake.
The student had shouted at Chief Magistrate Francis Andayi to be 'be objective'. When he was arraigned in court, he admitted his mistake and was freed without being charged with any offence.
“I did not mean to cause any disrespect. My act was out of ignorance, stupidity and over excitement. I regret that fact," admitted Graham
The chief magistrate was on the morning of Monday, January 27, forced to send Embakasi East MP Babu Owino back to remand after a group of youth disrupted the court proceedings.
"We cannot proceed with this hearing given the noise from the corridors. Now I ask the police to escort those making noise out of the court,” stated Wandayi.
After the order, police officers immediately swung into action and sent the attendees in the case out.
The rowdy youth stormed into the courtroom while state prosecutor Jacob Ondari was making submissions.
"For now, the accused person will be remanded in custody," declared the judge.
Embakasi East MP Babu Owino's gun drama case took another turn in court on Monday, January 27, after police pounced on one of his supporters.
According to a report by Daily Nation, the man was arrested after shouting at a lawyer from the Directorate of Public Prosecutions (DPP) office as the pre-bail hearing was ongoing.
The court had reconvened for the hearing in a case in which the lawmaker is accused of attempted murder after allegedly shooting a deejay identified as DJ Evolve (real name Felix Orinda) in the neck at a popular nightclub in Kilimani area of Nairobi.
The crowd, in a solidarity move with Owino, arrived at the Milimani Law Courts noisily and caused chaos at the entrance of the chambers.
During the proceeding, the family of the ailing DJ opposed the release of the lawmaker on either bail or bond arguing that if set free, Owino and his supporters posed a security threat to them.
The outspoken lawmaker was on Monday, January 20, remanded awaiting the bail report to be presented to Chief Magistrate Francis Andayi by the Department of Probation Services.
He was charged with two counts, attempt to commit murder and possession of a gun while drunk and disorderly.
The lawmaker pleaded not guilty to the charges leveled against him which include attempted murder, which carries a maximum sentence of life imprisonment.
The Directorate of Criminal Investigations on Friday, January 17 confirmed recovering a gun that was suspected to have been used by Embakasi MP Babu Owino to shoot the DJ at the popular B-club in Kilimani, Nairobi.
Felix Orinda otherwise known as DJ Evolve is recuperating at Nairobi Hospital.
Lawyer Cliff Ombeta, who represents Owino, told the court that he had documents confirming his client had paid Ksh600,000 to Nairobi Hospital to cover the cost of Evolve's treatment.
He requested that Babu be released on bond noting he had two young children and a wife at home.
