37 Kericho Members of County Assembly (MCAs) on Wednesday voted in support of impeaching Governor Eric Mutai after they accused him of a flurry of violations including abuse of office and misconduct.
This resolution was the culmination of deliberations by the county lawmakers after Sigowet Ward MCA Kiprotich Rogony tabled a motion to hound Mutai out of office on Tuesday.
In his impeachment motion, Rogony alleged Mutai contravened the constitution among other violations including misappropriating funds amounting to Ksh 9 million set aside to respond to and assist victims of the Londiani Tragedy which claimed 53 lives and left many more injured.
“The governor grossly violated article the provisions of Article 10, Article 73 and Article 75 of the constitution by overseeing the misappropriation of funds raised from the victims of the horrendous Londiani Junction Tragedy in which over Ksh 9 million of public funds were lost,” he read the notice in part.
The MCA alleged the Kericho County Government set aside Ksh9 million to compensate victims of the tragic accident. The money, he believes, has since not been accounted for.
After the motion was tabled, 37 out of 47 MCAs voted in support of impeaching the Governor. Kericho Speaker Patrick Mutai set October 2 as the date when the Governor will appear before the house to defend himself.
Rogony claimed misconduct by the governor painted the county in bad light and brought disrepute to the Office of the Kericho County Governor. In his view, Mutai's continued occupation of the position will affect service delivery.
“The governor has variously committed constitutional wrongs that subvert the structure of government and undermine the integrity of the office and even the constitution itself,” the MCA stated while moving the motion.
Further, Governor Mutai is accused of making unlawful appointments, unfair termination, seizing functions of the Public Service Board and making unlawful allocation of funds.
“The present and former chief executive committee members and chief officers have variously reported coercion by the Governor to make financial allocations for the Governor's use from the funds allocated to their respective departments and which funds they were required to remit through the Governor's personal assistants,” he stated.
Rogony alleged the Governor created a health crisis in Kericho County after unlawfully deploying health staff without the involvement of the County Service Board.
Further, according to the MCA, despite advertisements for the positions of county workers including health service providers and early childhood education (ECDE) professionals being floated, the positions were never filled.
