A court in Homa Bay on Thursday sentenced a 29-year-old man to 71 years behind bars after he was found guilty of raping and sodomising a 29-year-old woman within the county.
Resident Magistrate B.W. Murangasia ruled that the Office of the Director of Public Prosecutions (ODPP), through Prosecution Counsel Moses Okerosi proved beyond reasonable doubt that the culprit was guilty of the indecent act.
According to court documents, the culprit committed this heinous offence on February 25 this year within Ndhiwa Sub-County Homabay County.
The ODDP revealed that the man was sentenced following key shreds of evidence that were obtained from six witnesses that had been fronted by the prosecution.
This followed a chemical analysis of body samples that were taken from the man, which matched those obtained from his victim.
''The prosecution secured a conviction after six witnesses including a government chemist analyst and a clinical officer testified and presented exhibits in the case,’’ ODPP shared in a statement.
''An expert from the Government chemist informed the court that a DNA analysis of the spermatozoa was collected from the complainant and the conclusion was that the samples matched the DNA of the accused person,’’ ODPP added.
According to the Magistrate, the long jail term handed to the culprit was because his offence had a big psychological impact on the victim.
The evidence was further corroborated by a clinical officer who examined the complainant and noted that she had faecal stains in her private parts.
While handling the sentence, the court noted that the offence had a psychological impact and stigma on the complainant and sentenced him to 71 years imprisonment.
The Homabay ruling is a unique one, considering the number of years the culprit has been handed in prison for his acts.
In July this year, a 62-year-old man was handed a 40-year jail term for defiling an 11-year-old in Maraba, Kakamega.
