The Principal Registrar of Persons from Nairobi has been summoned by an Eldoret court in a case involving a land ownership dispute worth Ksh100 million.
The land case features a senior driver from the Judicial Service Commission (JSC) and a family in Uasin Gishu County.
On Wednesday, July 30, Justice Robert Wananda directed the registrar to appear in person or send a representative to give evidence regarding the birth records of Abraham Chebii, who claims ownership of the 37-acre piece agricultural land in the Kaptagat area.
Chebii explained to the court that he inherited the land from his late father, Paul Cherono.
He dismissed the other family's claims that his father was childless, describing them as a scheme to prevent him and his sister from receiving their inheritance.
Chebii informed the court that his father had had two children with their mother, Esther Chebet, before they separated over 40 years ago.
He stated that he had documents proving that the land belonged to his late father and that he could provide them to the court.
He added that his father had only leased the land to Philip Cheruiyot over 60 years ago, as he owned other land in Elgeyo Marakwet County.
However, Philip Cheruiyot’s family disagrees, claiming that the land belonged to their father. His eldest son, Cledy Kiprono, is leading the family's case.
They accuse Chebii of being a stranger with no connection to the property.
They have asked the court to prevent Chebii from accessing the land and to leave Elgeyo Marakwet, where he currently resides.
The case is scheduled to be mentioned on October 1, 2025.
