Madikizela Otieno Sues Loreto Convent Msongari for Sh26 Million Over Bus Accident

A former pupil of Loreto Convent Msongari is suing the School over an accident that occurred six years ago killing three pupils.

19- year-old Madikizela Otieno has sued the school management and the bus driver for negligence demanding compensation of over Sh26 Million for the accident that occurred during a Standard 7 and 8 trip.

“I suffered serious multiple injuries and incurred heavy expenses for which I seek compensation,” she said in a sworn statement.

Ms Otieno, who is now a first-year student at the University of Nottingham in the UK, told Justice Richard Mwongo that the amount would cover costs she accrued during treatment that was more than Sh12 Million and also for future medication.

In the accident where 69 other pupils and seven teachers were injured, she stated that she had to undergo several surgeries in Kenya and the UK as she had sustained extensive injuries on the head, face and right arm.

Ms Otieno told the court that the headmistress insisted on using one bus which was overcrowded despite questions from her school mates.

She also accused the driver of recklessness as she recounted that all she heard was screeches as the driver tried to apply brakes before the bus rolled several times.

The case will be heard on October 30 when the young woman’s mother, Rael Lubasi, will testify.
