High Court Allows DPP to Prosecute Kapseret MP Oscar Sudi Over Fake Academic Papers

The High Court has dealt a major blow to Kapseret Member of Parliament (MP) Oscar Sudi after ordering that he be prosecuted for submitting fake academic papers in the 2013 election.

The Court ruled that Mr Sudi's petition to block prosecution by the Director of Public Prosecution lacked merit.

The legislator had filed a case seeking to stop his prosecution over fake academic papers.

In 2016, the Ethics and Anti-Corruption Commission (EACC) conducted an investigation into Mr Sudi's academic record and revealed that he presented forged certificates to the electoral commission as he sought a nomination in the 2013 General Election.

EACC noted that Sudi's Diploma Certificate in Business Management and Kenya Certificate of Secondary Education certificate were forged.

According to the report, the MP also made a false declaration under oath through a self-declaration form to IEBC.

"The MP uttered the said forged documents to IEBC and EACC with intentions to deceive the two commissions," the report read in part.

A report was compiled and forwarded to the DPP on June 17th, 2016 recommending that the MP be charged with three counts of forgery.
