NLC Revokes Title Deed of former Nyeri Governor Nderitu Gachagua's Sh1 Billion Land

The National Land Commission (NLC) has revoked the title deed of former Nyeri Governor Nderitu Gachagua's 1.2-acre piece of land located in Lang’ata, Nairobi.

The land, which hosts 80 middle-class apartment units, is registered to Vipingo Beach Resort Limited, a firm owned by the family of the former Nyeri Governor.

The firm had obtained a court order temporarily suspending NLC’s revocation which the Commission failed to appeal against.

Vipingo Beach’s lawyer, Njoroge Regeru accused NLC of violating another court judgment delivered in 2015, which confirmed the firm as the legal owner of the land valued at Sh1 Billion.

The piece of land located in Nairobi’s South C estate has 80 apartments built on it and is registered under Gachagua family’s company.

In March, NLC announced a plan to compensate Gachagua’s family after the land was obtained by the Government to facilitate the expansion of the Southern Bypass.

The Commission issued a notice, through the Kenya Gazette, inviting parties interested in the investment to file claims for compensation by 3rd April.

In 2012, Vipingo Beach Resort filed a case in court claiming that the property’s value amounted to Sh800 Million.

NLC then requested time to evaluate and determine how much the government was required to pay in compensation.

Later in February 2016, the High Court ruled that Gachagua be compensated at a rate determined by the Land Commission.

The late Gachagua owned 89.94% stake in the company, one Susan Nderitu owns 10%, the former Governor's brother Rigathi Gachagua owns 0.01% while a Mr Kenneth Gachagua owns 0.05%.
