Nyamira Governor John Nyagarama Blocked from Executive County Appointments

Nyamira Governor John Nyagarama has been blocked from hiring and laying off staff in his County Government.

The Employment and Labour Relations Court granted a court injunction against an earlier job advertisement aiming to recruit persons to fill the positions of 10 chief county officers and one county secretary.

Mr Vincent Mariita Omao had petitioned the court to overturn the recruitment exercise claiming that the advertised positions were not vacant.

The petitioner termed the executive action as illegal and unfair as the involved workers were still in office and still executing their duties.

"The affected officers’ employment contracts have not expired and the county government has breached their contractual terms," Mr Omao's court papers read in part.

The suit was filed against Nyamira County, the Governor, County Secretary, Chairperson and Secretary of Nyamira County Public Service Board. 

The court's ruling comes soon after Public Service Cabinet Secretary Sicily Kariuki wrote to the Council of Governors instructing them to cease the arbitrary suspension of county workers.

The case will be heard on September 21.
