Petition Filed Against IEBC in High Court

A petition has been filed in the High Court seeking the removal of all eight Independent Electoral and Boundaries Commission (IEBC) commissioners.

Brian Azin, Ben Wanasakaali and Kelvin Alwanga filed the case seeking to bar IEBC Chairman Wafula Chebukati and CEO Ezra Chiloba from conducting the fresh presidential election scheduled for October 17.

The petitioners through their lawyers Michael Amalemba and Conrad Maloba argued that the IEBC Commissioners could not be trusted with the repeat presidential poll having bungled the August 8 General Election.

“They have been found guilty by the court with the indictment, they have fallen short of provisions of Chapter 6 of the Constitution and Section 4 of the 4th Schedule of IEBC Election Act,” Amalemba argued.

Justice Roselyn Aburili directed all the parties involved in the suit who include the IEBC Commissioners, the Jubilee Party and Attorney General to file their responses within 14 days.

Justice Aburili certified the petition as an urgent matter and scheduled it to be heard on September 22.

Earlier on, Chebukati appointed a new project team for the October elections who included Mr Marjan Hussein Marjan (Project coordinator), Dr Sidney Namulungu (Head of Operations),Ms Nancy Kariuki (Head of Logistics) Mr Bernard Misati Moseti (Head of Training) Mr Albert Gogo (Head of ICT) and Mr Silas Rotich (Head of National Tallying Center).

On Monday Chebukati announced that Chiloba would oversee the new project team.
