New Plan to File Petition Against Maraga Disclosed

A section of Jubilee Party Members of Parliament is said to be preparing to file a petition to oust Chief Justice David Maraga.

The MPs are reportedly planning to introduce the petition in the National Assembly seeking the removal of Maraga and Chief Registrar of the Judiciary Anne Amadi.

According to sources privy to the issue, the scheme is to have the matter tabled before the House once all the legislators, including the newcomers, go through training on proceedings of Parliament.

The lawmakers allegedly plan to use the Ethics and Anti-Corruption Commission (EACC) to institute frivolous investigations against the two judicial officers.

“The plot is to frame the CJ and Registrar with non-existent charges then pass the resolution in the House to have them investigated by the Ethics and Anti- Corruption Commission (EACC) not because the accusations are serious but to besmirch their character,” a report by the Nation states.

Kenya Magistrates and Judges Association (KMJA) has, however, criticised the move which it says is related to the nullification of the presidential election.

Through Secretary General Bryan Khaemba, the body noted it was aware of the plan insisting it would ensure it defends the independence of the Judiciary.

“We are aware of the scheme by a number of MPs to force the Hon CJ and CRJ out of office, following the recent nullification of the Presidential elections. I wish to remind these schemers that the true meaning of the rule of law, is that a country is governed by the law and not men,” Khaemba stated.

On Thursday morning, Nyeri Town MP Wambugu Ngunjiri filed a petition to the Judicial Service Commission seeking the removal of the CJ on several grounds.

This has since been disputed with Jubilee, through Secretary General Raphael Tuju, distancing itself from the matter.
