Chief Justice David Maraga will set up a bench of judges for the hearing Thirdway Alliance presidential candidate Ekuru Aukot's case.
Aukot is seeking to be included in the October 17 presidential repeat poll and the case will be heard on Thursday.
The directions were issued when Dr Aukot, who took part in the presidential petition filed by National Super Alliance (NASA) leader Raila Odinga, appeared before the registrar.
Representatives of other parties named in the case — President Uhuru Kenyatta, National Super Alliance candidate Raila Odinga, Prof Michael Wainaina, Attorney-General Githu Muigai and Law Society of Kenya (LSK) — also attended the session.
In the petition, Dr Aukot has faulted the Independent Electoral and Boundaries Commission (IEBC) for limiting the number of candidates who will participate in the fresh election to two.
