ODM Official in Court Over Forging Election Results

A polling official who managed the Orange Democratic Movement (ODM) party nominations for Muhoroni constituency is back in court over forgery accusations.

Mr Peter Oyuko was accused of having forged an affidavit that led to court battles between former MP Ayiecho Olweny and elected MP Onyango K'Oyoo.

The polling official, who is also a primary school headteacher, had sworn before the Supreme Court of Kenya that Prof. Olweny had won the party nominations.

Chief Justice David Maraga, DCJ Philomena Mwilu, Justices Mohammed Ibrahim, Smokin Wanjala and Isaac Lenaola ruled to dismiss the case and Mr K'Oyoo went on to win the parliamentary election.

Mr Oyuko was subsequently charged with forgery and released on a Sh300,000 bond.

On Wednesday, he filed a petition at the High Court seeking to challenge the forgery charges against him.

Resident Magistrate Martha Agutu allowed his petition and ordered that proceedings against the accused be delayed until the case is heard.

The case will be mentioned on October 17.
