Why Ekuru Aukot's Bid to Attend IEBC Meetings Failed

Thirdway Alliance Presidential candidate Ekuru Aukot was denied access to the joint Independent Electoral and Boundaries Commission (IEBC) meeting with the Jubilee Party and National Super Alliance (NASA) held on Wednesday.

Through his lawyer Elias Mutuma, Dr Aukot wanted all parties to be involved in the preparation meetings for the October 26 fresh presidential election.

Nonetheless, IEBC lawyer Paul Nyamodi objected Dr Aukot's request to attend the session noting that his presence will be a prejudice to the electoral commission.

Mr Nyamodi pointed out that the electoral agency would risk loosing vital information if Dr Aukot participates in the meetings and the court dismisses his quest to participate in the repeat polls.

Aukot, who came fifth in the August presidential race, had filed a petition with the Supreme court seeking to have his name included in the ballot papers used in the upcoming polls set for October 26th.

The apex court dismissed the petition saying the matter was not within its jurisdiction prompting Aukot to move back to the High Court.

On Friday, Dr Aukot filed another suit in the High Court seeking to suspend printing of the ballot papers to be used in the presidential election.

Dr Aukot accused the IEBC of unlawfully gazetting President Uhuru Kenyatta and NASA leader Raila Odinga as the only candidates in the upcoming presidential elections.

“IEBC and Mr Chebukati, in breach of rules of natural justice and without due regard to the law, have failed to gazette Dr Aukot as a presidential candidate despite him having been duly nominated as a presidential candidate in the August 8 polls just like the two," he noted.

“Unless this matter is heard and determined urgently, Dr Aukot and his voters are likely to suffer injustice and irreparable loss having been unlawfully excluded," he stated.

The matter is yet to be determined.
