Machakos High Court Makes U-Turn in Wavinya Ndeti's Case

The High Court in Machakos on Wednesday made a U-turn on Wavinya Ndeti's petition on the matter regarding the storage of election material used in the August polls.

The court reconsidered its original order where they had directed that materials used by the IEBC should be stored at its premises.

This was after it was discovered that the space at the Court premises was small and could not fit all the election material.

Following the discovery, both parties involved in the petition visited the IEBC County offices after which new orders were issued that the boxes and material used in the contest be stored at the Commission's warehouse in the County.

Wavinya's lawyer Dan Manzo, while speaking to Kenyans.co.ke stated that some of the ballot boxes were not in good condition while some had missing seals.

He, however, explained that the Court had put in place effective measures to ensure that the materials are protected.

"The courts have made a move to preserve them. They have put the election material in one corner in the IEBC county offices where they are locked using 4 padlocks from each party," he stated.

Maanzo explained that the move to lock the boxes with 4 padlocks was due to the high number of people frequenting the room adding that police had also been ordered to protect the ballot.

Last month, Wavinya moved to court challenging Governor Alfred Mutua's re-election. In her petition, the former legislator wants a scrutiny of votes cast in the election.

The case is being heard by Justice Aggrey Muchelule and will have a pre-trial on October 18th, 2017.
