IEBC commissioners are in a meeting with their legal team seeking advice on the way forward following the withdrawal of NASA presidential candidate, Raila Odinga from the upcoming election.
Following the withdrawal, the electoral body stated that it had received the official letter from the Opposition regarding the withdrawal.
The Commission has the mandate to interpret what the pull out means as per the Constitution.
NASA has alleged that the withdrawal should lead to a fresh poll, which should be held with fresh nominations of candidates by political parties.

The subsequent presidential election will involve other interested parties and candidates not limited to NASA and Jubilee.
This is a contradiction to what the Gazette Notice by the IEBC indicates after the August 8 presidential election was annulled by the Supreme Court.
The IEBC relied on the Gazette Notice of September 5 that declared the fresh presidential election would be between President Uhuru Kenyatta and Mr Odinga.

However, Kenyatta’s team insists that the IEBC should proceed and declare him President unopposed.
The IEBC has the option of taking the view of the Supreme Court that ordered the fresh election and ignore the withdrawal by NASA.
This will prompt the electoral body to go ahead and hold an election and supervise it with the NASA presidential candidate on the ballot, then go ahead to declare the winner.
