Court Issues Order Against Governor Waititu

Kiambu Governor Ferdinand Waititu and all his officials have been barred from accessing a Sh100 Million property within the Central Region county.

Environment and Lands Court Judge Lucy Gacheru on Thursday ruled against the county government that was in the process of taking over land belonging to the Postal Corporation of Kenya.

Posta, enjoined with Fave Gas Oil Limited, had moved to court against the Governor and his operatives after they allegedly invaded the three-quarter-acre property.

Governor Waititu gave his officials liberty to access the land in preparation for an expansion of a county bus park that lies adjacent to the land in contest.

The petitioners moved to court last week, as soon as the Governor's order took effect, claiming that the county government had already used earth movers to destroy structures within the property.

Postmaster-General Dan Kagwe told the court that he had attempted to reach an amicable agreement with Governor Waititu.

According to Mr Kagwe, the state corporation and the county government had drawn up a lease agreement concerning the land.

The lease allowed Fave Gas to put up a petrol station on the property in a deal, Mr Kagwe explained, was blatantly ignored.

Following the plight, Justice Gacheru issued the temporary orders for restricted access to the disputed land. 

"An order is issued restraining the county or its agents from interfering with the applicant’s land, cutting down the trees or destroying structures therein pending the hearing of the suit," Justice Gacheru ordered.
