New Petition to Nullify Presidential Election Filed At Supreme Court

The battle over the just concluded presidential election is set to go back to the Supreme Court after activist Okiya Omtatah filed a petition seeking to nullify the process.

The petition which was filed on Friday contested the validity of the repeat poll even before the Independent Electoral and Boundaries Commission (IEBC) declares the winner. The petition has included all the presidential candidates as interested parties.

In an exclusive interview with Kenyans.co.ke, Mr Omtatah affirmed that is he challenging the credibility of the whole process which he termed a sham.

Omtatah stated: “Yes I have already filed a petition at the Supreme Court. My grievances are that Kenyans are being duped with this sham process.”

He wants the court to bar the IEBC from announcing the results of Raila Odinga who abandoned the election on October 10 through a letter addressed to the electoral body.

“We cannot settle for such a mechanism to conduct an election. When Raila announced his withdrawal from the poll then this whole thing collapsed. IEBC should have held fresh nominations within 60 days as per the constitution,” he added.

He further insisted that he was not interested in the results and he did not include that in the suit he filed.

The activist stated that the IEBC did not work within the mandate of the Constitution and misused taxpayers' money and it should be held accountable.

“The Supreme Court Judges nullified the whole process and trusted the IEBC to oversee and manage the election in a plausible manner. They have wasted Kenyans money and they should also be held liable on that,” he concluded.

IEBC went ahead and conducted the repeat presidential election on Thursday even after Chairman Wafula Chebukati stated that he could not guarantee the credibility of the October 26 poll.

He cited the division that the commission was facing among its commissioners as his biggest challenge.
