Gov't Suspends David Ndii's Passport

The Ministry of Interior and Coordination of National Government, through the Immigration Department, on Monday suspended the passport of National Super Alliance (NASA) Chief Strategist David Ndii.

In a statement addressed to the NASA official, he was notified of the suspension by the Director of Immigration Department services Gordon Kihalangwa.

He was further ordered to surrender the passport to the Director of Immigration Services at Nyayo House within 21 days failure to which the passport would be rendered null and void. 

"In pursuant to Section 31(1) (2) of the Kenya Citizenship and Immigration Act (2011), you are hereby notified that Passport Number C051258 which is in your possession remains suspended forthwith," part of the statement read.

In reaction to this, Mr Ndii noted that the Director had made the order using laws which are not stipulated in the Constitution.

Justifying this statement, he quoted: "The immigration officer, shall on suspending or confiscating the passport inform the holder in writing, within seven days, citing the reason to surrender the passport."

According to reasons cited by Ndii for the confiscation of the passport include issuance of a warrant of arrest against the holder and if the latter is involved in passport or document fraud.

Others include:

"The holder has been deported or repatriated to Kenya at the expense of the Government."

"The holder is a person against whom there is a court order restricting movement or authorizing denial, confiscation or suspension of the passport."

"The holder is convicted for drug trafficking, money laundering, acts of terrorism or any other international crime."

Earlier on, Ndii, alongside other NASA officials had moved to court seeking anticipatory bail regarding the purported crimes associated with the swearing in of NASA leader Raila Odinga.

The High Court granted Sh100,000 anticipatory bail and ordered Police not to arrest the politicians. They were also ordered to report to Directorate of Criminal Investigations (DCI) Headquarters on Wednesday 11 am.
