Court Overturns Matiang'i's NRM Ban

A Nairobi High Court on Friday quashed the Gazette Notice by Interior Cabinet Secretary Fred Matiang'i that outlawed the National Resistance Movement (NRM).

Justice John Mativo issued this directive barring CS Matiang'i from implementing and effecting this notice pending the hearing and determination of the case.

The movement which is considered an arm of the Opposition National Super Alliance (NASA) had been outlawed and declared an organized criminal group after the inauguration of Raila Odinga as the People's President.

The former Education CS cited Prevention of Organised Crimes Act 2010 when making the declaration.

“In exercise of the powers conferred by section 22 of the Act, the Cabinet Secretary, Ministry of Interior and Co-ordination of National Government declares National Resistance Movement (NRM) to be organized criminal group for the purposes of the Act,” it read.

NRM was formed in late 2017 when Raila was questioning the preparation and conduct of the repeat presidential election arguing that it fell short of the standards set by electoral laws stipulated in the Constitution.

The movement agitates for electoral reforms and boycott of products and services provided by companies accused to be pro-government. The Government vowed to crack the whip on the individuals who associate with it.

After the arrest of the self-declared General of NRM Miguna Miguna, the DCI said that he was arrested for administering an illegal oath and being a member of NRM.

“Miguna publicly declared that he is the general of NRM, which is already declared a proscribed group. By the time he declared publicly, there was a gazette notice by the minister. How can we let it go? We are law enforcers," he stated.
