Petition to Remove CJ David Maraga Filed in Parliament

A lawyer has petitioned the National Assembly seeking the removal of Chief Justice David Maraga, Deputy Chief Justice Philomena Mwilu and five more members of the Judicial Service Commission (JSC).

The petitioner, Adrian Kamotho Njenga, also wants Justice Mohammed Warsame, Aggrey Muchelule, Tom Ojienda, Emily Ominde, and Mercy Deche booted from the JSC.

Njenga states in his petition that the seven JSC members are unfit to hold office on grounds of, among others, "serious violation of the constitution including Chapter Six of the Constitution".

He further claimed that they had "failed to promote and facilitate the independence and accountability of the judiciary and the transparent administration of justice".

Njenga, who describes himself as 'an ardent defender of the constitution', called for Parliament to initiate the removal of the seven from office on grounds of gross misconduct and incompetence.

He accused those named in his petition of having shielded, protected and exonerated judges engaged in gross misconduct.

His letter to Parliament read in part: "They have without any constitutional regard or justification dismissed petitions presented to the JSC."

Notably, following the nullification of the August 8 General Election by the Supreme Court, Nyeri Town MP Ngunjiri Wambugu filed a petition with the JSC seeking the removal of Maraga.

Wambugu, however, dropped the petition, citing 'the political situation in the country'.

In February, Jubilee Party Secretary-General Raphael Tuju wrote a hard-hitting letter to CJ Maraga, accusing the judiciary of not having the country's best interests at heart.
