Supreme Court Judge Drafted Petition to Remove CJ David Maraga - Nelson Havi Reveals

City Lawyer Nelson Havi on Tuesday disclosed the legal minds he claims participated in the drafting of the petition filed on Monday seeking to remove CJ Maraga and his deputy Philomena Mwilu from office.

Taking to his Twitter page, Havi divulged that it was one Supreme Court Judge and 3 Judges of the Court of Appeal. 

"The petition for removal of CJ Maraga and other JSC Commissioners is frivolous but well thought of and drafted. It is not the work of an idle nondescript LLM student but that of 1 SCOK and 3 COA power hungry but gullible Judges whose foot and fingerprints are all over it, " he noted.

Speaking to Kenyans.co.ke, the former Law Society of Kenya presidential aspirant refused to name the individuals he called out in his post. 

Asked why he believed that senior judges were involved in the matter, he maintained that he could not divulge more details on the same.

Flamboyant lawyer Donald Kipkorir also reiterated that Parliament is not in any position to remove the Chief Justice as the constitution is very clear on the process to be undertaken to achieve that. 

"Constitution is VERY CLEAR: Judiciary is Independent & Only JSC can initiate removal of Judges, " Kipkorir posted on his Twitter page.

The lawyer went ahead condemning the media for "falling to a falsified claim," alleging that the petition was filed by a "madman in a market."

Senior Counsel Ahmednasir Abdullahi also commented on the issue divulging that Adrian Kamotho, the man who submitted the petition to Parliament, is not a lawyer.

"...He is a busybody who litigates in court...and calls himself Chairman of ICT Kenya, " posted the respected lawyer.

The petitioner also wants Justice Mohammed Warsame, Aggrey Muchelule, Tom Ojienda, Emily Ominde, and Mercy Deche booted from the Judicial Service Commission.
