Mutahi Ngunyi Statement After Judge Odunga Fined CS Fred Matiang'i

Outspoken lawyer Mutahi Ngunyi stated that Judge George Odunga could have given Interior Cabinet Secretary Fred Matiang'i, IG Joseph Boinnet and Immigration PS Gordon Kihalangwa a heavier sentencing of either 'death' or jail term.

Through a Twitter post on Thursday Ngunyi noted that Judge Odunga had shown judicial elegance.

Ngunyi wrote: "Justice Odunga has shown judicial elegance. He could have sentenced Matiangi and co. to 'death' or Jail."

The controversial lawyer argued that Justice Odunga had done what was achievable by law.

He further noted that the judge defused a tense situation that was emerging between the government and the judiciary.

However, Ngunyi noted that the ruling could have put lawyer Miguna Miguna in a tricky situation and opened him up to deportation in the future.

"This means Miguna can be deported a fourth, fifth and Ninth time," Ngunyi wrote.

On Thursday judge Odunga stated: "The money will be deducted from their salaries. The registrar should make sure this happens."

Odunga noted that since the respondents are in charge of security, it will be difficult for their juniors to execute warrants of arrest.

"None of their juniors will hold them in custody. This court cannot make orders in vain. I must make sure the laws are abided by," he ruled.

The judge maintained the three state officers are in violation of Article 10 of the Constitution on National values and principles of governance.
