High Court Orders Nairobi Women's Hospital to Pay 11-year-old Ksh54 Million

The Nairobi Women's Hospital was on Thursday ordered by the High Court to pay a compensation amount of Ksh54 Million to an 11-year-old boy.

Judge Mbogholo Msagha found the hospital culpable for causing the young boy's cerebral palsy when he was born at the hospital.

"The mother and child would not have found themselves in that situation had prudent and professional attendance been extended to them," Judge Msagha stated in his ruling.

The judge further justified his ruling stating that the two deserved the compensation for the difficulties they passed through over the years.

He also cited that the child's condition was irreversible as evidenced by his first courtroom appearance. The judge described that the child seemed incapacitated and had a blank stare.

The boy's mother, Purity Kemunto, told the court that she visited the hospital and was induced into labour with very grievous consequences.

Ms Kemunto blamed the hospital attendants for not giving her proper attention during her ordeal.

The woman further claimed that she had been left with nine-years worth of huge medical bills and was also abandoned by her husband.

"I have been left to look after the child single-handedly and this will be an expenditure that will be there for as long as the child is with me," she narrated.

The costs were broken down as follows: cost of speech, occupation and physiotherapy (Ksh18.7 Million), education (Ksh6 Million), personal hygiene (Ksh2.8 Million), medical consultations (Ksh3.3 Million), medication (Ksh9.6m Million), caregiver (Ksh.7.2 Million), adaptive equipment (Ksh3.6 Million) and special damages (Ksh631,000).
