Miguna Miguna Moves to High Court Demanding to Pick Port of Entry Back to Kenya

Miguna Miguna's lawyers on Friday moved to the High Court demanding to pick his preferred port of entry for the embattled lawyer's return to Kenya.

In court papers, the lawyers demanded that their client is allowed the right to choose how he will get into the country without restrictions. 

The new suit also asked the court to compel the government to allow the lawyer to return from Canada using his national identity card or a new passport.

The court papers further sought to secure orders from the court forcing the government to hand over Miguna's re-entry documentation to the Kenya National Commission on Human Rights (KNHRC).

Respondents listed on the suit are Kenya Airports Authority (KAA), Interior Cabinet Secretary Fred Matiang'i, Inspector General of Police Joseph Boinnet, the GSU commandant, Jomo Kenyatta International Airport (JKIA) OCS or any other, the Flying Squad boss, Kenya Police and the Attorney General.

The lawyer asked the court to further hold the listed individuals in contempt of court if his return was not facilitated.

Miguna also asked the court to direct that five of his lawyers will be granted unfettered access to him upon his return.

The self-declared freedom fighter further specified that not less than three KNCHR officials should be provided to escort him through the immigration and customs areas.

One of the lawyers who filed the suit told reporters that it had been necessitated by the government's failure to comply with court orders while alleging that they already have.

"Our position is that there has been no compliance with the orders issued earlier but the government insists they have," lawyer Julie Soweto stated.
