Nyali MP Mohamed Ali Denies Defaming Kirinyaga Governor Anne Waiguru Over NYS Scandal

Nyali Member of Parliament (MP) Mohammed Ali has denied accusations held against him by Kirinyaga Governor Anne Waiguru.

Ali was answering to Waiguru's threat to sue him for allegedly linking her to the Ksh9 billion NYS scandal.

The lawmaker refuted claims by the County boss that he published defamatory and false information about her.

Through his lawyers, Chelanga Kihungi & Associates, the former investigative journalist noted that the Public Accounts Committee (PAC) of the National Assembly conducted an audit of NYS accounts and submitted a report in March 2017.

The lawyers also gave inserts of the report in their response to Waiguru's threat and stated that their client had only called for its implementation.

"Our client is an MP duty-bound under article 95 of the Constitution to exercise oversight over state organs and resolve issues of great public concern," the lawyers also noted in their statement.

They added that he did not make any conclusions on the culpability of those he mentioned in the statement he issued on June 19.

"The statement referred to is privileged and is accordingly immune from legal proceedings under applicable laws," the advocates stated.

Through her lawyers, Governor Waiguru had demanded a written apology from the legislator within seven days.

The governor also directed Mr Ali to urgently admit to the fault and take responsibility for any damages she may have suffered through the publication.
