Former Nairobi Deputy Governor Polycarp Igathe has withdrawn a case against former nominated Senator Paul Njoroge who shot at him in 2017.
The clip that went viral showed Njoroge firing his Ceska pistol in the air twice when Igathe, then Vivo Energy MD, tried to repossess the petrol station in the outskirts of Naivasha town.
During the court proceeding on Thursday, Naivasha Chief Magistrate Kennedy Bidali was informed that the complainant (Igathe) had reached an out of court settlement with the accused.
Due to the circumstances, the prosecution sought to withdraw the case.

“The accused person and the complainant have resolved issues culminating from the case and have mutually resolved and the matter is marked as settled,” read the consent in part.
On his part, Njoroge through his lawyer, Francis Mburu applied to have his gun returned as well as a refund of the Kshs.50,000 cash bail.
The Magistrate granted the application agreeing with the decision by both parties.
After the ruling, Njoroge addressed the media outside the law courts expressing optimism following the settlement. He, however, noted that he would continue battling the company.
“Am happy that this case has been dropped but am not yet done with Vivo Energy Company which illegally took over the petrol station that I have been running,” he told journalists.
Following the gun drama incident in 2017, Igathe went on to run for Nairobi leadership under Mike Sonko. They won the election under a Jubilee ticket but due to differences with his boss, he resigned in January 2018.

He later landed a job at Equity Bank as the Chief Commercial Officer but explained that he would still serve Nairobians as an advisor, but did not mention which specific office he would be an advisor to.
"It has been a great pleasure serving Nairobians & I will continue to serve as an advisor beyond my previous position of Nairobi County Deputy Governor," Igathe wrote.
