Matiang'i Declares Wednesday Public Holiday

Interior and Coordination of National Government CS Dr. Fred Matiang'i on Monday announced that October 10 will be a public holiday.

In a statement sent to newsrooms, Matiang'i upheld the decision by the court for October 10 to be observed as a public holiday.

"In Judicial Review No. 292 of 2017 (Republic v Cabinet Secretary for Internal Security Ex Parte G O Nyauchi & 4 Others), the Court affirmed that the 10th of October remains a public holiday to be observed as such. Going by this decision, therefore, 10th of October shall be a public holiday," read the statement.

He further explained that the ministry had made a proposal to parliament to review the Public Holidays Act.

"In line with Section 7 of the Sixth Schedule to the Constitution, and arising from the aforesaid court ruling, the Ministry was in the process of making proposals to Parliament for the comprehensive review of the Public Holidays Act, Cap 110 but was unfortunately caught up with time.

"The review will address all outstanding matters with respect to public holidays and embrace the spirit of the Constitution on how our heroes will be celebrated," added the statement.

The once Education CS made reservations on how the day will be celebrated.

This comes following an uncertainty since the government had not declared whether the day will be a public holiday or not following the ruling that was made by Justice George Odunga in 2017.

"I further declare that unless and until Parliament amends Schedule 1 of the said Act or the minister substitutes the same for another date, the 10th of October in each year shall continue being a Public Holiday," stated Judge Odunga.

The court had heard that the decision to scrap off the holiday had denied workers a chance to have the day off and allowances for that day.
