Senator Murkomen Dares DPP Noordin Haji Over Hiring of Queen's Counsel

Elgeyo Marakwet Senator Kipchumba Murkomen on Saturday dared Director of Public Prosecution (DPP) Noordin Haji over the hiring of Queen's Counsel Khawar Qureshi.

Terming the hiring of Qureshi by DPP as demeaning the Kenyan lawyers, Murkomen dared Haji to personally prosecute the case against Deputy Chief Justice Philomena Mwilu.

"The idea of getting a foreign Advocate to prosecute domestic cases just before our Independence Day is totally misguided.

"If the DPP mistrusts all the Kenyan Lawyers he should just have led by example and prosecute the case himself," Murkomen stated.

Decrying the outsourcing of a foreign prosecutor over 50 years after independence, the Senate Majority Leader equally put to question Haji's prowess in legal matters.

"Some of those moments we agree. But I again ask is the DPP competent to appear in court himself?

"If not where does he get the ability to determine cases that should or should not proceed for prosecution?" he posed.

The hiring of Qureshi by the DPP has caused jitters among a section of Kenyans who opposed the move.

In particular, the Mwilu's legal team led by Senator James Orengo opposed the contracting of Qureshi arguing that the DPP did not have powers to appoint him and that he was not licensed to work in the country.

The Prosecution team, however, opposed Orengo's claims maintaining that such comments were tantamount to questioning the powers of the Attorney General and the DPP.

In a rejoinder, DPP Haji asked for Senators Orengo and Okong'o Omogeni to be disqualified from Mwilu's case.

The DPP argued that the legislators enjoy parliamentary privileges to question the parties in Senate committees hence their participation would create conflict of interest.
